TERMS OF USE NORDIC CIRCLE

1. Scope, Contracting Parties

1.1 These Terms of Use (“Nordic Circle Terms of Use”) apply to your participation in the Nordic Spirit customer loyalty program (“Nordic Circle”) of JTI Austria GmbH, Erdberger Lände 26a/71, 1030 Vienna, Austria, company registration number FN 309726f (“JTI or We”). JTI operates the website www.nordicspirit.at and is your contractual partner within the framework of the Nordic Circle. You can contact us with any questions or concerns as follows:

After registering for your user account on our website and successfully completing the age verification (you must be at least 18 years old), you can register for the Nordic Circle at any time directly in your user account profile by selecting the corresponding tick box.  Within the Nordic Circle, members can participate in various activities, for example:

·         Members can collect points in various ways, including registering for the Nordic Circle, purchasing products, participating in online games, competitions, etc. These points can then be redeemed on our website – depending on the offer – for various rewards, such as Nordic Spirit goodies, event tickets, etc.

·         Members can use our "Invite Friends - Member get Member" offer and also collect points by inviting their adult friends.

1.2 Participation in the Nordic Circle is exclusively open to consumers ("B2C") as defined in Section 1 of the Austrian Consumer Protection Act (KSchG). A consumer is any natural person for whom the legal transaction is not related to the operation of their business. Participation by businesses (such as retailers) or for commercial purposes in the Nordic Circle is excluded.

1.3 By registering for the Nordic Circle, you accept the Nordic Circle Terms of Use in the version valid at the time of your registration. You can access the Nordic Circle Terms of Use directly on our website and save and/or print them on your computer.

 

2. Eligibility, registration, contract conclusion

2.1 You are only eligible to participate in the Nordic Circle if you (a) are a consumer (section 1.2), (b) have created a user account on our website, (c) have been confirmed as being of legal age after successful age verification, and (d) have your primary residence in Austria. All personal information provided must be correct and truthful and must be verifiable by JTI upon request. You are obligated to keep your personal and contact information provided in connection with your use of the Nordic Circle up to date. There is no legal entitlement to participate in the Nordic Circle. JTI is entitled at any time and without giving reasons to refuse admission to the Nordic Circle or to subsequently exclude you from further participation.

2.2 Participation in the Nordic Circle is free of charge for the member and independent of the purchase of goods or services.

2.3 Your participation in the Nordic Circle begins once you have created your user account on nordicspirit.at, verified your age, and given your consent to participate. Only one participation in the Nordic Circle is possible per person. Membership in the Nordic Circle and the associated offers and benefits are non-transferable.

2.4 The Nordic Circle is not available in all countries. Your Nordic Circle membership is limited to Austria. If you move your primary residence outside of Austria, your Nordic Circle membership will automatically expire.

2.5 Declarations and actions made or carried out under your name after your registration for the Nordic Circle using your contact details (email, address, and date of birth) may be attributed to you even if you are unaware of them (in which case there is a rebuttable presumption that you acted yourself). Attribution therefore occurs in particular if you intentionally or negligently grant third parties access to your login data or your personal area on our website. To prevent misuse, you are obligated to treat your login data as strictly confidential, keep it inaccessible to third parties, and log out of the Nordic Circle website after each session. If you suspect misuse of your access, you are obligated to inform us immediately.

 

3. Collecting and redeeming Nordic Circle points

3.1 For example, you can collect points through the following activities:

·         Subscribe to the newsletter

·         Register your participation in the Nordic Circle

·         Birthday bonus

·         Refer a friend (“Invite friends – Member get Member”)

·         Requesting a free sample ("Free Sample")

·         Purchasing a product with a special "code" on the packaging

·         Participation in customer surveys

·         Participation in a 1-2-1 activity

·         Entry of codes which are distributed via social media platforms

·         Reading blog posts

·         Participation in quizzes or competitions

·         Scanning points as part of “offline activations”

·         Nordic Circle Anniversary (you get extra points on the anniversary of your registration) etc.

We reserve the right to change the activities through which points can be collected at any time without giving reasons.

The number of points to be collected can vary depending on the activity and is shown for each activity.

The activities for which you can collect points vary from time to time and may be conducted in cooperation with appropriately commissioned Nordic Spirit partner companies. The activities listed above are merely examples. The actual activities will be announced – depending on availability – in the Nordic Circle section of our website or via our social media channels and are subject to change. There is no entitlement to the participation of the activities listed above. Activities (e.g., surveys and quizzes) can generally only be completed once. Multiple participation in an activity is only possible if this is explicitly stated in the description. Points can only be earned by the member themselves and are not transferable to other people.

3.2 The points are stored in your user account and credited to your account shortly after purchase. You can then view your current points balance via your user account on our website.

3.3 Points are not transferable to third parties or other members. Points cannot be redeemed for cash.

3.4 The mention or presentation of products, services and/or activities on nordicspirit.at within the framework of the Nordic Circle does not imply or guarantee that these products or services are available at all times or that points can be collected and/or redeemed for them within the framework of the Nordic Circle.

3.5. The products, services, and/or activities may differ from their illustrations on the website. The illustrations on our website are for illustrative purposes only. Although we have made every effort to display the colors accurately, we cannot guarantee that your computer's color display will perfectly match the color of the products.

Deviations may affect product packaging, the type, color, size or appearance of the offered rewards (e.g. Nordic Spirit Goodies / offered vouchers, tickets etc.), as these may differ from the images on our website.

3.6. Points can be redeemed in the Nordic Circle section of our website (www.nordicspirit.at) by exchanging them for various Nordic Spirit goodies or vouchers/tickets from partner providers.

3.7. We only ship Nordic Spirit goodies or vouchers/tickets within Austria. Unfortunately, we cannot deliver to addresses outside of Austria. The shipping of the free samples is organized on our behalf by our service provider, Professional Logistics Solutions GmbH, Inkustraße 1-7, Top 15, 3400 Klosterneuburg. The Nordic Spirit goodies or vouchers/tickets will be sent to you free of charge.

3.8. We will deliver your Nordic Spirit Goodies to the address you provided during the ordering process in Austria, or to the email address you registered in your user account in the case of vouchers/tickets. We primarily use Austrian Post for deliveries, but may also use UPS, DHL, or other shipping providers. Deliveries generally take place Monday to Friday.  We will send you an email as soon as your order has been shipped so that you can check/track the status of your order.

3.9. Delivery can take up to 14 days from the date of your order. If we are unable to deliver your Nordic Spirit Goodies or vouchers/tickets within this period, we will contact you to inform you. If your order could not be delivered and/or was not collected from the collection point after a reminder, the order will be returned to us.

3.10 We are not responsible for delays beyond our control. Should the delivery of Nordic Spirit Goodies be delayed due to an event beyond our control, we will inform you as soon as possible and take steps to minimize the impact of the delay.

3.11. Should you have any questions about your Nordic Spirit Goodies or vouchers/tickets or any reason for complaint, please contact our consumer service at konsumentenservice@jti.com or 0800 40 48 08, who will be happy to assist you.

 

4. Invite friends – “Members get Members”

4.1 As part of the Nordic Circle, we offer you the opportunity to invite your friends to the Loyalty Club through the activity "Invite Friends - Member get Member" and to generate points for the Nordic Circle through this recommendation.

4.2 Nordic Circle Codes may only be passed on by you to adult users of tobacco or nicotine products.

4.3 Commercial use of the "Invite friends – Member get Member" function is prohibited (see also point 6.1 in this context).

4.4 The “Invite friends – Member get Member” function is limited to a total of 50 successful (forward) recommendations.

4.5 Publishing The use of Nordic Circle Codes by you via social media platforms, eBay or other online marketplaces is prohibited.

 

5. Validity and expiry of Nordic Circle points

Earned points expire on December 31st of the second year following their acquisition. Points are automatically applied in order of age upon redemption, meaning older points are used first. If your user account is terminated or the Nordic Circle loyalty program is discontinued, all points will be forfeited without compensation. Points from a previous user account will not be revived, even if you subsequently register again.

Example for illustration :
Points acquired on January 1, 2025 will expire on December 31, 2027.

Points acquired on December 31, 2025 will also expire on December 31, 2027.

 

6. Abuse

6.1 You or Nordic Circle members are acting abusively within the meaning of these Nordic Circle Terms of Use if your actions violate any of the regulations mentioned in these Nordic Circle Terms of Use (for example, by participating in the Nordic Circle in the course of a commercial or independent professional activity).

6.2 Collected points are not transferable to third parties. Selling, exchanging, offering for auction, or otherwise transferring points to third parties is prohibited. Brokering the purchase or sale of points, as well as buying points from members or third parties, is also prohibited.

6.3 In the event of a breach of these terms of use, we reserve the right to deactivate your user account, declare your collected points invalid, and exclude you from further participation in Nordic Circle (see section 9.3 below).

 

7. Data protection

The collection, processing, and use of personal data within the Nordic Circle is described in our privacy policy for our website. You can view the privacy policy at Privacy Policy – ​​Nordic Spirit Austria . This privacy policy is not part of these terms of use and therefore not part of this agreement; it serves only to inform you about the processing of your personal data.

 

8. Changes to the Nordic Circle Terms of Use

8.1 JTI reserves the right to amend or supplement the Nordic Circle Terms of Use, including the validity period of the points, with effect for the future.

8.2 Should these Nordic Circle Terms of Use be amended, you will be informed accordingly via your user account or the change will be announced by email. If you wish to continue using the benefits of Nordic Circle after receiving this notification, you agree to the amended Nordic Circle Terms of Use.

8.3 Participants in Nordic Circle have no legal right to participate in Nordic Circle and JTI reserves the right to discontinue Nordic Circle at any time without replacement, in particular if Nordic Circle or the underlying products may no longer be offered due to legal changes.

 

9. Termination

9.1 You can cancel your participation in the Nordic Circle at any time by sending us an email to the email address mentioned in point 1.1.

9.2 JTI may terminate your participation in the Nordic Circle at any time with one month's notice by email or letter.

9.3 Furthermore, JTI is entitled to terminate your participation in the Nordic Circle without notice (and without observance) for good cause by email or letter. Good cause exists in particular if you have violated the obligations set out in these Nordic Circle Terms of Use, such as any attempt to transfer or sell points or Nordic Circle benefits, making it unreasonable for JTI to continue your membership.

9.4 Your collected points will expire upon termination of your contract.

 

10. Liability

10.1 In the event of breaches of duty – regardless of the legal basis – JTI shall be liable for intent and gross negligence within the scope of fault-based liability. However, this limitation of liability does not apply to compensation for personal injury. Otherwise, in cases of simple negligence, JTI shall only be liable for damages resulting from a material breach of a fundamental contractual obligation (an obligation whose fulfillment is essential for the proper performance of the contract and on whose compliance the contractual partner regularly relies and may rely); in this case, however, liability shall be limited to compensation for foreseeable damages that typically occur.

We are not liable for damages resulting from unsuitable or improper use of the delivered Nordic Circle Goodies, faulty or negligent consumption, handling, or storage of the goods. Furthermore, we are not liable for indirect damages, lost profits, consequential damages, pecuniary losses, or damages resulting from third-party claims. 

10.2 The foregoing limitations of liability also apply to third parties for whose fault JTI (e.g., as vicarious agents) is responsible. Claims under the Product Liability Act are governed exclusively by the statutory provisions.

 

11. Final Provisions

11.1 These Terms of Use Nordic Circle and the contractual relationship with you are governed by Austrian law, excluding the conflict of laws rules of the Austrian Private International Law Act (IPRG) and the UN Convention on Contracts for the International Sale of Goods (CISG).

11.2 The jurisdiction of Austrian courts applies.

11.3 Severability Clause. Should any provision of these Nordic Circle Terms of Use be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. Invalid or unenforceable provisions shall be interpreted or supplemented in such a way as to achieve the economic purpose pursued by the invalid or unenforceable provision to the greatest extent possible.

11.4 Language. These Nordic Circle Terms of Use are drawn up in German and English, whereby in case of discrepancies between the German and English versions, the German version shall prevail.
